GENERAL TERMS AND CONDITIONS


These General Terms and Conditions (these “GTC”) comprise the rights and obligations of clients (the “Client”) using the electronic commercial services of SIKOSZ Korlátolt Felelősségű Társaság (registered seat: 1068 Budapest, Király utca 106. 2. em. 2.; company registration no.: 01-09-919097; registered by the Fővárosi Bíróság, as the court of registration; tax ID. no.: 14771525-2-42; contact details: e-mail: info@ourstyle.hu, telephone: +36 70 335 0793; the “Service Provider”) (the Service Provider and the Client: the “Parties”).
General provisions, the conclusion of the contract between the Parties

1.1 The scope of these GTC includes every electronic commercial service provided within the territory of Hungary through the electronic web store of the Service Provider (the “Web store”) on the http://ourstyle.hu/ website (the “Website”). Furthermore, the scope of these GTC includes every commercial transaction within the territory of Hungary which takes place between the Parties.
Shopping at the Web store is regulated by Act CVIII of 2001 on Electronic Commerce Services and Information Society Services (the “ISS Act”) and by Government Decree no. 17/1999 (II. 5) on Distance Contracts (the “Government Decree”).

1.2 Shopping at the Web store may occur by an electronic order, in a manner set out in these GTC.

1.3 Any person shall be entitled to use the services provided by the Web store, if he/she accepts the contents of these GTC as binding on himself/herself.

1.4 The contract which is concluded between the Parties by the Client making an order and accepting the offer of the Service Provider, shall be considered as a written, electronic contract whose content shall be archived and shall be accessible or traceable for 2 years from the conclusion thereof. The language of the contract shall be Hungarian, or English if this option is individually chosen.

Orders
2.1 Registration is not a prerequisite for making an order, but it facilitates the making of further orders. You can choose an item with the order “add to basket” after choosing its colour and size.  If there are no items in the desired size in stock, the Client has the option to “pre-order.” The specific conditions for pre-orders are provided on the Website.

2.2 The essential properties and attributes of the purchased item can be learned from the information panel of the given item. Should you have any questions about the item prior to its purchase, we are kindly at your disposal at the info@ourstyle.hu e-mail address.

2.3 The purchase price is always the price shown next to the selected item, which includes value-added tax, unless it is separately indicated. The purchase price of the product does not include the costs of shipping.

2.4 The Service Provider reserves the right to alter the prices of the items appearing on the Website, with such alteration coming into effect with its appearance on the Website.

If, despite the due care of the Service Provider, an incorrect price appears in the Web store, with special regard to obviously incorrect prices, e.g. a price significantly differing from the publicly known, generally accepted or usual price, such as the appearance of a price of HUF “0” or HUF “1”, then the Service Provider shall not be obliged to ship the item at the incorrect price, but may offer shipping at the correct price, in the knowledge of which the Client may withdraw his/her intention to purchase.

2.5 The Service Provider shall only accept orders made via its Website if the client completely fills in all boxes necessary for making an order. The Service Provider shall not bear any liability for delays in shipping or other problems or failures arising from false or incomplete data submitted by the Client in the order.

2.6 Means provided for the Client to identify and amend the information given by the Client prior to placing his/her order: all items are to be found on the main page of the Website in the “Basket” menu. The content of the Basket can be checked, changed or emptied at any time. We kindly ask you to check prior to placing your order whether you have chosen and placed into your basket items of the right size and colour.
If you have ordered by mistake something other than what you wanted and you recognise your mistake after you have placed your order, please inform us immediately at the info@ourstyle.hu e-mail address or on the +36 70 335 0793 phone number. It is important for you to notify us immediately following your order, as after the item has been delivered the mistake can not be undone.

2.7 The Client, by placing an order and by accepting the terms and conditions of the purchase by ticking the correspondent box, accepts these GTC and considers them as binding on himself/herself.

2.8 The Service Provider shall be obliged to electronically verify (via e-mail) the purchase to the Client, following the receipt of the Client’s order. The order and its verification shall be considered as having arrived when it becomes accessible for the Parties. In case this verification does not arrive at the Client within 48 hours from the sending of the order, the binding force of the order on the Service Provider and all obligations of the Client shall automatically cease to exist. The language of the verification shall be the same as the language of the order.

2.9 Certain items from the Website are produced based on special orders. In such cases the Parties may derogate from the provisions of these GTC by mutual agreement, considering the properties of the item and the fulfilment of the contract, with special regard to the production of the item and its shipping to the Client.

Shipping and payment conditions
3.1 The items ordered will be handed over after receiving the verification in the manner indicated in the order, by shipping made by our freight forwarders or at our business premises. The item may be paid for electronically using our Website (with credit/debit card or by using Paypal), or by cash at the time of the delivery by the freight forwarders or in our business premises. Payment with cash at delivery is only available for the Client if the item is shipped within the territory of Hungary.

3.2 The delivery cost shall be borne by the Service Provider in case of orders above a gross amount of HUF 50,000 (i.e. including VAT). In case the order is not above a gross amount of HUF 50,000, the Service Provider will ship the item within the territory of Hungary for a fixed delivery cost of HUF 1,500 by using freight forwarders. In this case the delivery cost shall be borne by the Client, in such a way that the delivery cost is separately indicated in the invoice. The supplier reserves the right to alter the delivery cost, with such alteration coming into effect at the time of its appearance on the Website. Any such alteration shall not affect the purchase prices of products that are already ordered.

3.3 The Service Provider provides the Client with the possibility to choose the time of delivery. An employee of the freight forwarder company shall call the Client on the previously provided phone number to set the date and time of the delivery with the Client. It is not possible to choose an exact delivery time, but rather a short time window for delivery. The Service Provider, unless otherwise provided by the express, mutual agreement of the Parties, shall fulfil its obligations within 30 days from the date of the order.

3.4 In case the Service Provider cannot fulfil its contractual obligations because it does not have the contractual item at its disposal, or it cannot provide the ordered service, the Service Provider shall immediately inform the Client about this fact and shall immediately, but not later than within 30 days, repay the sum paid by the Client.

3.5 Regarding each placed order, the Client, at the time of delivery, shall be obliged to carry out an itemised inspection of the delivered package, and where the order has been completely fulfilled, the Client shall sign the receipt. After this, the Service Provider shall not be able to accept any complaints in connection with any incomplete fulfilment of the order. Please make written notes of any complaints regarding the delivery or the ordered item in the presence of the freight forwarder.

3.6 The Client – with a prior request - may also take over the item in person, in the Service Provider’s place of business.
The Service Provider’s place of business is: 1053 Budapest, Henszlmann Imre Str 3.

3.7 The Service Provider shall fulfil the order at the place confirmed in its verification of the receipt of the order sent via e-mail to the Client. The Client, except for his/her first order, where the delivery address shall be identical to the invoice address, may in all cases choose a delivery address different from the invoice address.

Right, method and consequences of withdrawal
4.1 If the Client decides to withdraw from the contract after delivery of the item, the Client may exercise such right of withdrawal within 8 working days from the delivery of the item without giving any reasons. In the case of a written withdrawal statement, it will be sufficient if the statement is posted within 8 working days from delivery.

4.2 The time of take-over, in the case of a take-over in the shop, shall be the time of the take-over in the shop; in the case of delivery, it shall be the time of take-over from the freight forwarder. The time of take-over shall be verified with the bill/invoice or the invoice received from the freight forwarder.

4.3 Any returned item shall be returned in an original, undamaged condition, together with the invoice, to the Service Provider’s place of business. The Service Provider shall only be obliged to refund the full price when the item is returned in a new (undamaged, complete) condition. In case the item was used, or the Client cannot return it in an undamaged condition, the Service Provider shall not be obliged to refund the full price. Any exercise of the right of withdrawal shall not result in any extra costs for the Client; however the Client shall be responsible for returning the item. If the right of withdrawal is exercised in writing, it will be sufficient if the statement of withdrawal is posted within 8 working days, and the Client also has to return the item as soon as possible.

4.4 The Client shall not be entitled to exercise the right of withdrawal, as provided in section 4.1., in the case of ordering an item which was created based on a special order given by the Client, or at his/her express request, according to section 2.9 of these GTC.

4.5 In case the returned item fulfils the above conditions, the Service Provider shall be obliged to refund the full purchase price to the Client, as defined by the law in effect, within 30 days from the take-over of the item.

Guarantee, warranty
5.1 In respect  of guarantee and warranty claims, the provisions of Act IV of 1959 on the Civil Code and the provisions of GKM Decree no. 49/2003 (VII.30.) on guarantee and warranty claims to be asserted in the case of agreements concluded with consumers shall be applicable.

Miscellaneous provisions
6.1 Making a purchase using the Website assumes the Client’s awareness of the technical limitations of the Internet and the acceptance of faults arising from this technology. We advise you to use up-to-date anti-virus and anti-spyware programs, and to always have installed the current security updates of your operating system.

6.2 The Service Provider shall not be liable for any damage arising out of connecting to the Website. The Client shall be liable for the protection of his/her computer and the data thereon.

6.3 The Service Provider shall store the data supplied by the Client only for the purpose of fulfilling the order and to verify in the future the terms and conditions of the agreement eventually concluded by the Parties. The Service Provider shall not provide any third parties other than subcontractors/agents of the Service Provider acting to fulfil the contract, with the Client’s data. The Service Provider by handling the Client’s data shall always act in accordance with the provisions of Act LXIII of 1992 on the Protection of Personal Data and the Disclosure of Information of Public Interest.

6.4 The Service Provider is entitled to send to users newsletters and other advertisements if the user gave his/her unambiguous, express and voluntary consent to this at the time of registration by giving his/her data. The Service Provider is not obliged to check whether the data given by the user are correct at the time of registration or at any subsequent time while consent has been given.
The user is entitled to withdraw his/her voluntary consent set out in this clause at any time. In case of such a withdrawal, the Service Provider shall not send any newsletter or advertisement in the future and shall erase the data of the user from the list of users who have subscribed for the newsletter.

6.5 The Service Provider is entitled to unilaterally alter these GTC at any time. Any such alteration shall come into effect with its appearance on the Website.
6.6 Consumer complaints shall be dealt with in writing at the info@ourstyle.hu address and/or on the +36 70 335 0793 phone number of the Service Provider, with calls to such phone number being handled between 10 am and 6 pm CET time.
